SD – Use Self-Storage services?? GET YOUR REFUND!!

South Dakota Supreme Court ruled in December that self-storage is not taxable.  Therefore, if you’ve used these services in the past, you are able to petition the state for a refund.  If you are a customer of self-storage services, then you must ask for that sales tax money back from the vendor who charged it to you by Sept. 15, 2009.  If you are a vendor, then you have to file for your refund by Oct. 1, 2009 for any taxes that were refunded to customers.

Perhaps that is why SD is looking to raise the sales tax rates as I previously reported.  They need to make up for the expected $1M lost revenue.

[...] Posted by salestax on August 19, 2009 Some time ago, two very brave business owners subjected themselves to sales tax statute scrutinization of their mini/self-storage business.  These brave souls won their case almost a year ago and it now stands that basic Mini/Self storage services are not taxable in SD anymore.  Further, SD is allowing any customers who had been charged tax on these services to go back to the storage business and request a sales tax refund (See my previous report).  [...]
