New York – Seeking Taxpayers by threatening others.

Basically, what’s happening is that the State of New York is trying to find out if there are any Franchisees, Alcohol Retailers or Vehicle Repair Shops who aren’t registered to collect/remit sales taxes; and for those who are registered, to make sure that the purchases by these businesses match up to what the is shown as their sales on which taxes are collected from ultimate consumers on the filed tax returns. This is just one more way NY is keeping up on the fraud in their state. On one hand…good, on the other… big brother.

1. TSB-M-09(9)S, New Requirement for the Filing of Information Returns for Franchisors

This memorandum announces the amendments to the Tax Law that require franchisors, that have at least one franchisee that is required to register as a sales tax vendor, to file information returns that identify each franchisee and account for its sales and purchases.

2. **UPDATE**  This infomrational return is no longer a requirement.  But now, wholesalers must collect exemption certificates from resellers.  Changes for collecting exemption certificates from Liquor resellers is effective in Feb ’10.  http://tinyurl.com/y8dju4f

TSB-M-09(10)S, New Requirement for the Filing of Information Returns for Alcoholic Beverage Wholesalers

This memorandum announces the amendments to the Tax Law that require alcoholic beverage wholesalers to file information returns with the Tax Department regarding their sales to vendors whose business includes the retail sale of alcoholic beverages.

TSB-M-09(8)S, New Requirement for the Filing of Information Returns for Insurers of Motor Vehicles

This memorandum announces the amendments to the tax law that require motor vehicle insurers that issue motor vehicle damage insurance to file information returns with the Tax Department regarding their payments to vendors who are in the business of repairing and servicing motor vehicles.
